Terms of Service

1. Acceptance of Terms

By accessing or using SendexAPI (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service. These Terms apply to all users including individuals, developers, and organisations accessing the Service via the dashboard or API.

2. Description of Service

SendexAPI provides an email infrastructure platform that allows you to send transactional and marketing email through a REST API. Features include:

  • Transactional email sending (single and batch) via API
  • Broadcast campaigns to audience lists
  • Audience and contact management with topic-based subscriptions
  • Domain verification and DKIM signing via AWS SES
  • Inbound email (webmail inbox) for verified domains
  • Email templates with AI-assisted generation
  • Webhook delivery for email and broadcast lifecycle events
  • API key management with scoped permissions
  • Activity logs and sending statistics
  • Credits-based billing

We reserve the right to add, modify, or discontinue features at any time with reasonable notice.

3. Prohibited Use & Email Content

The Service may only be used to send email to recipients who have given clear, explicit consent to receive communications from you. The following are strictly prohibited and will result in immediate account suspension:

  • Sending spam, bulk unsolicited email, or email to purchased, rented, or scraped address lists
  • Phishing — email designed to deceive recipients into disclosing credentials, payment details, or personal data
  • Impersonating a brand, company, government agency, or individual you are not authorised to represent
  • Distributing malware, ransomware, or links to malicious or deceptive content
  • Advance-fee fraud, lottery scams, prize scams, fake invoice scams, or any deceptive financial solicitation
  • Sending from a domain flagged as malicious by industry reputation services
  • Violating CAN-SPAM, CASL, GDPR, or any other applicable anti-spam or data protection law
  • Attempting to circumvent sending limits, automated monitoring, or abuse detection systems

No refunds for prohibited use. Credits consumed in connection with any prohibited activity — including spam, phishing, or any other violation of this section — are non-refundable. Sendex reserves the right to retain all fees paid in connection with a suspended or terminated account where prohibited use is found to have occurred.

4. Accounts & API Keys

You are responsible for maintaining the confidentiality of your account credentials, API keys, and any secrets generated through the Service. All activity that occurs under your account or API keys is your responsibility. You must notify us immediately at [email protected] if you suspect unauthorised access. API keys should never be exposed in client-side code or public repositories.

5. Credits & Billing

The Service operates on a prepaid credits model. Credits are deducted per email sent. Billing and payment processing is handled by our payment provider Polar. Unused credits do not expire but are non-transferable. Refunds for credits are issued at our discretion except in the case of a verifiable Service outage on our part. Credits consumed through prohibited use are non-refundable under any circumstances.

6. Sending Limits & Automated Monitoring

All accounts are subject to daily sending guidelines based on account tier. These are not hard blocks — they trigger automated AI review of sending content and patterns to detect abuse. Accounts may be automatically suspended if bounce rates exceed 4% over a 15-day window, or if AI content analysis determines that emails contain phishing, spam, or other prohibited content. Legitimate senders are not affected. If you believe a suspension was made in error, you may appeal by contacting support.

7. Domain Verification

You may only send email from domains you own and have verified through the Service. By adding a domain you confirm you are authorised to configure DNS records for it. Sendex performs automated reputation checks on domains at the time of registration. Domains flagged by industry blocklists (including Spamhaus and Google Safe Browsing) will be rejected.

8. Intellectual Property

The Service, its interface, and underlying technology are the exclusive property of SendexAPI. You retain ownership of content you submit through the Service (email content, templates, contact data). By using the Service you grant us a limited licence to process and transmit that content solely for the purpose of providing the Service.

9. Termination

We may suspend or terminate your access immediately and without prior notice for any material breach of these Terms, including prohibited use. You may close your account at any time by contacting support. Upon termination, your API keys are revoked, queued sends are cancelled, and your data is retained for 30 days before deletion unless you request earlier removal.

10. Limitation of Liability

To the fullest extent permitted by law, SendexAPI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including email delivery failures, delays, or third-party provider outages. Our total liability shall not exceed the amount you paid for the Service in the 30 days preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless SendexAPI, its directors, employees, and partners from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or email content you send through the platform.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a dashboard notice. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

Privacy Policy

1. Information We Collect

We collect the following categories of information:

  • Account data: email address and authentication provider information (Google, GitHub, or magic link sign-in)
  • Email data: sender address, recipient addresses, subject lines, email body, previews, and attachments for emails sent or received through the Service. Email bodies and subjects are encrypted at rest.
  • Domain data: domain names, DKIM tokens, and verification status for domains you register
  • Contact & audience data: email addresses, names, and subscription preferences for contacts you manage through the platform
  • API key data: key prefixes, permission scopes, domain restrictions, and usage timestamps (full key values are never stored)
  • Usage data: send counts, bounce and complaint events, delivery status, and activity logs
  • Billing data: credit balance and purchase history (payment card details are handled entirely by our payment processor and never stored by us)
  • Communications: messages you send us via support or feedback forms

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service
  • Process and deliver email on your behalf
  • Send transactional notifications (e.g. magic links, account alerts, suspension notices)
  • Detect and prevent spam, phishing, and other abusive activity — including automated AI analysis of email subject lines and previews
  • Monitor bounce and complaint rates to protect shared sending infrastructure
  • Generate aggregate usage statistics and improve the platform
  • Respond to support requests
  • Comply with legal obligations

3. AI Processing

Sendex uses automated AI systems to detect spam and phishing in emails sent through the platform. This analysis processes email subject lines and short text previews (up to 120 characters) only — full email bodies are not sent to AI systems. Subject and preview text may be transmitted to third-party AI providers (currently OpenRouter) for this purpose. This processing is conducted solely for abuse detection and the protection of all platform users.

4. Third-Party Service Providers

We work with the following third-party providers to operate the Service. Each acts as a data processor under our instruction:

  • Amazon Web Services (SES, S3): email delivery and attachment storage
  • MongoDB Atlas: primary database storage
  • Redis: rate limiting and job queue processing
  • OpenRouter: AI-based spam and phishing detection (subject and preview only)
  • Google Safe Browsing: domain reputation checks at domain registration
  • Spamhaus: domain blocklist checks at domain registration
  • Polar: billing and payment processing

We do not sell your personal data to any third party.

5. Contact Data You Upload

When you manage audiences and contacts through the platform, you are the data controller for that contact data. You are responsible for ensuring you have a lawful basis for storing and emailing those contacts, and for honouring unsubscribe requests. Sendex processes this data solely to provide the Service to you.

6. Data Retention

We retain your account and sending data for as long as your account is active. Sent email records are retained to support delivery tracking, bounce monitoring, and audit purposes. Upon account deletion, data is removed within 30 days unless retention is required by law. You may request earlier deletion by contacting support.

7. Cookies & Session Data

We use session cookies to maintain your authenticated state in the dashboard. We do not use third-party advertising or tracking cookies. You can control cookies through your browser settings, though disabling session cookies will prevent you from signing in.

8. Security

Email subjects, bodies, and previews are encrypted at rest. API keys are hashed and never stored in plaintext. All data is transmitted over TLS. We implement access controls, monitoring, and automated abuse detection to protect your data and the platform. No method of transmission or storage is 100% secure and we cannot guarantee absolute security.

9. Your Rights

Depending on your location, you may have rights to access, correct, delete, restrict, or export your personal data. To exercise these rights, contact us at the address below. We will respond within 30 days.
